Before you defend, settle or proceed, examine the record.
Tribunals decide fitness for work, mitigation of loss and what was said online on the same evidence as any other court — the record that already exists. Extant checks what a matter rests on against what is there to be found.
Use cases
- Due diligence before a claim is taken on or a defence is committed to
- Fitness for work, working while absent and mitigation of loss, tested against the record
- Publication and conduct: what was posted, and what remains
When the record reached the tribunal
- Atkinson v SGN Contracting (2025) — a claimant unfit for any work was found to be working for a competitor throughout; the claim failed and he was ordered to pay £20,000 in costs.
- Elrick v Bilfinger UK (2025) — a "silent partner" whose company was advertising and trading online; all claims dismissed, and £10,919.91 of sick pay ordered repaid.
The record cuts both ways. Over-reading a post loses cases too — which is why Extant reports what the record shows, and states as plainly what it does not.
What you receive
A disciplined document, not a data dump: findings addressed to your objective, every one referenced to its source, captured and preserved as found, presented in a format designed for use in proceedings. Where the record warrants deeper enquiry, the Report says so and defines the scope.
